Supporting Documents

There are supporting documents that you must file with your application. These documents get filed in addition to the documents listed on the previous page: 'What you need to file'.

The forms you need to complete and file depend on what it is you want to apply for.

Forms are posted in interactive PDF format and Word format.

If you are using the interactive PDF forms, be sure to download and save them to your computer to access all the features, including instructions to guide you through what information is required from you.

Parenting:

I want a court order dealing with parenting arrangements: If you are asking to address parenting arrangements (like decision-making responsibility, parenting time, or moving with a child), you must fill out and file a Parenting Statement Form FD2A Form FD2A

I want to apply for contact time or interaction: If you are asking for contact time or interaction, you must fill out and file a Statement of Contact Time and Interaction Form FD2B Form FD2B .

Child Support:

I want to deal with child support : If you are addressing child support, you must file your Statement of Income Form FD3 Form FD3 with attachments if you are:

• going to be the person paying child support;
• looking for the other parent to contribute toward special expenses for the child;
• addressing child support in a shared or split parenting arrangement;
• making an undue hardship claim;
• addressing child support for a child who is 19 years of age or older (note: The child over 19 may also have to file their income information).

If you are asking to receive child support, and none of the bullets above apply to you, you likely will not have to file your income information.

The attachments to a Statement of Income generally include:

• Last 3 years’ Income Tax Returns and Notices of Assessment or Re-assessment from the Canada Revenue Agency; and
• Current income information like:
  • If you are employed: your 2 most recent paystubs
  • If you are unemployed: your 2 most recent benefit statements (for example, from Employment Insurance, Workers’ Compensation, medical insurance, Income Assistance, CPP or other pension information)
  • If you are self-employed: your 3 most recent completed tax returns with attachments, including statement of business activities OR the 3 most recent financial statements of your business or professional practice.

  I want to ask for money towards the children's special expenses : If you want to ask for a contribution to the children’s special expenses - like childcare, health expenses, university costs, and extracurricular activities - you must fill out a Statement of Special or Extraordinary Expenses Form FD4 Form FD4 , and attach receipts or other documents showing the costs of the expenses you are claiming.   Spousal Support:

  I want to deal with spousal support : If you are asking to address spousal support for the first time, whether you are the payor or recipient, you are required to file the following:

  • Statement of ExpensesForm FD6Form FD6
  • Statement of PropertyForm FD7Form FD7
  • Statement of IncomeForm FD3Form FD3with attachments

  These attachments to a Statement of Income generally include:

  • Last 3 years’ Income Tax Returns and Notices of Assessment or Re-assessment from the Canada Revenue Agency; and
  • Current income information like:
    • If you are employed: your 2 most recent paystubs
    • If you are unemployed: your 2 most recent benefit statements (for example, from Employment Insurance, Workers’ Compensation, medical insurance, Income Assistance, CPP or other pension information)
    • If you are self-employed: your 3 most recent completed tax returns with attachments, including statement of business activities OR the 3 most recent financial statements of your business or professional practice.

    NOTE: When dealing with spousal support - if you are married, have lived with your common law partner for 2 or more years, or are in a registered domestic partnership, your spouse/partner must also file their Statement of Expenses, Statement of Property, and Statement of Income.

    Property:

    I want to deal with a division of property, pensions or debts : If you are asking to address division of assets or debts, you must file your Statement of Property Form FD7 Form FD7 .

    I want to ask for exclusive occupation (or possession) of the home :

    There are two main laws in Nova Scotia that deal with this issue – the Parenting and Support Act and the Matrimonial Property Act .

    You can only use the Matrimonial Property Act if you are married to the other party, or if you have registered with the government as ‘registered domestic partners’ with that person.

    The Matrimonial Property Act deals with ‘exclusive possession’ of a ‘matrimonial home.’ It does not deal with rentals, like apartments .

    You can make an application under the Parenting and Support Act for exclusive occupation of a family residence, including an owned home, a home for which you are paying a mortgage, or a rental unit (like an apartment).

    If you are applying for exclusive possession under the Matrimonial Property Act or the Parenting and Support Act, you must file your Statement of Property Form FD7 Form FD7 .

    When you are filing an application, you must generally provide the court with the original and three copies of every document, or at least a copy for the court, a copy for you, and a copy for every other party.
